Section I: Grounds for Immediate Termination
Clinicians contracted or employed by Mindtra Health, LLC ("Mindtra") are expected to adhere to the highest standards of ethical and professional conduct. Any clinician who engages in behavior that reflects poor clinical judgment or otherwise jeopardizes member safety, well-being, or quality of care may be subject to immediate termination following review by the Clinical Leadership Team.
Immediate termination may occur after a single instance of gross negligence or incompetence, or for repeated acts of negligence or incompetence, with or without prior warning. Examples include, but are not limited to:
- Sexual harassment or misconduct
- Discrimination based on age, gender, gender identity, race, ethnicity, culture, national origin, religion, sexual orientation, disability, or socioeconomic status
- Member abandonment or neglect, including failure to arrange for continued care during absences such as vacation or illness
- Clinician behavior that impairs care delivery, such as intoxication, vaping during session, or conducting appointments while driving
- Breaches of confidentiality or HIPAA violations, including conducting sessions in public settings without reasonable privacy measures
- Providing unauthorized services
- Practicing outside the legal scope of licensure
- Failing to comply with mandated reporting laws, including child abuse, elder abuse, intimate partner violence, and active suicidality
- Use of non–evidence-based practices deemed harmful by regulatory bodies (e.g., conversion therapy)
- Canceling Mindtra appointments to serve clients through another professional entity (e.g., a private practice)
- Failing to document risk in the member's record and/or not following safety protocols
- Any act that places a member's well-being at risk or causes demonstrable harm
- Engaging in insurance fraud, such as billing for unprovided services or misrepresenting session times
Mindtra reserves the right and may be required to report unlawful or unethical practices to licensing boards, regulatory agencies, or accreditation institutions.
Section II: Progressive Discipline and Corrective Action
Clinicians who exhibit ongoing patterns of unprofessional or substandard conduct may receive a formal warning and be required to participate in corrective action. Repeated violations following a warning may result in termination upon review by the Clinical Leadership Team. Quality assurance and chart reviews may be conducted at any time.
Examples of behaviors subject to progressive discipline include:
- More than two verified complaints related to clinical ethics or professionalism
- Frequent no-shows or cancellations with less than 24-hour notice
- Repeated failure to appear on camera during sessions
- Consistent delays in completing case notes or failure to meet documentation and discharge requirements
- Pattern of unresponsiveness to member messages or internal communication from Mindtra staff
- Ignoring requests or directives from clinical leadership regarding documentation or care standards
- Excessive requests to reassign members
Compliance
All clinicians are expected to comply with this Code of Ethical Conduct. Compliance reflects legal, ethical, and professional obligations inherent in the provision of behavioral health services.
Exceptions
There are no exceptions to this policy.
Non-Compliance
Violations of this Code, whether intentional or unintentional, will result in consequences aligned with the severity of the infraction, including warnings, corrective action plans, or termination. Mindtra maintains zero tolerance for unethical clinical conduct.
