Welcome to the website of Mindtra, LLC ("we," "us," "our," or "Mindtra"), located at www.mindtrahealth.com (the "Site"). Please read these Terms of Use (the "Terms") carefully, as they govern your use of our Site and our Services.

The Site provides a platform for users to learn about mental health, understand treatment options, and connect with a Healthcare Provider for treatment, if desired (the "Services"). The Services may include:
The features of the Services offered by Mindtra may change from time to time, and Mindtra may choose to discontinue any or all of the Services at its sole discretion. Reasonable efforts will be made to notify users of significant changes.
Mindtra connects users with licensed providers for mental health diagnoses, therapy, and psychiatric treatment (including prescriptions, excluding controlled substances). Services are available in Florida.
To receive such Services, you must: (1) be at least 18 years of age or have parental/guardian consent if between 13 and 17; and (2) agree to the Telehealth Consent policy. Services are not available to minors under 13.
By using our Services, you agree to be bound by these Terms. The Terms are binding upon your heirs, successors, and assigns. If you do not agree, do not use the Services.
Please refer to our Privacy Policy and Notice of Privacy Practices for details on how we collect, use, and protect your information. Your use of the Services confirms your consent to those policies.
Mindtra participates in Health Information Exchanges (HIEs) or Networks (HINs) to improve care. We may share PHI with authorized providers. Sensitive data (e.g., Part 2, HIV, genetic info) is excluded. To opt out, email info@mindtrahealth.com.
We may update these Terms at any time. Notice of updates will be provided on the Site or directly to users. Continued use of the Services constitutes acceptance of the revised Terms.
Eligibility. Services are only available to those 18+, or 13–17 with parental consent. Services are not available to those under 13.
Registration and Your Information. Creating an account requires accurate, complete, and current information.
Account Protection. You are responsible for maintaining your account confidentiality and all activity under your account.
Feedback submitted to Mindtra grants us a worldwide, perpetual license to use, copy, and adapt it for any purpose.
Mindtra requires payment for some Services via subscriptions or insurance. Cash-pay users agree to recurring fees until cancellation. Insurance users may owe copays, deductibles, and other costs.
Subscriptions. Subscription fees are charged monthly. Cancellation takes effect at the end of the billing cycle. No refunds are issued once services begin.
Canceling Your Subscription. To cancel before your first appointment for a refund, notice must be given 24 hours in advance. Cancellations after this point are not eligible for refunds.
Cancellation and No-Show. Missed appointments without 24-hour notice may result in a no-show fee of up to $200. Fees apply based on appointment type and payment model.
Other Fees. Additional charges may include late cancellations or rescheduling with less than 24-hour notice.
Insurance. When using insurance, you authorize us to bill your plan and to charge your card for uncovered costs.
Services are for personal, non-commercial use. You may not copy, modify, or exploit the content without permission.
You must meet with a psychiatric provider at least every 180 days and with a therapist every 60 days (if applicable). Inactivity may result in restricted access.
You may not use the Services unlawfully, impersonate others, or record sessions without consent. AI transcription is prohibited without prior authorization.
Mindtra owns all rights to Site content. Unauthorized use or distribution is prohibited.
We may link to third-party sites. Mindtra is not responsible for their content or practices.
You may cancel your account at any time. Mindtra may suspend or terminate accounts for violation of these Terms. Termination does not entitle you to a refund.
The Services and content are provided "as is." We disclaim warranties of fitness, reliability, and availability.
Mindtra does not endorse specific medications or treatments. Services are not a replacement for in-person emergency care.
You agree to indemnify Mindtra against claims related to your use of the Services.
Mindtra is not liable for indirect damages. Maximum liability is $100 or the amount paid in the past 5 months.
These Terms are governed by Florida law. Disputes will be resolved in Miami-Dade County, FL.
All disputes must be resolved via binding arbitration in Miami, FL. Class actions are waived.
We may notify you via the Site, email, or phone.
You consent to receive communications from us. Message/data rates may apply. You may opt out of marketing messages.
If a provision is invalid, the remainder remains effective.
Failure to enforce a provision is not a waiver of our rights.
