Notice of Privacy Practices

This Notice of Privacy Practices ("Notice") is provided on behalf of Mindtra Health, LLC ("Mindtra"). It describes how medical information about you may be used and disclosed, and how you can access this information. It also outlines your rights regarding your protected health information ("PHI"). PHI includes any identifiable information about your past, present, or future physical or mental health condition and related health services.

Standard Uses and Disclosures of Your PHI

Mindtra may use or disclose your PHI without your written authorization for purposes of treatment, payment, healthcare operations, and other legally permitted or required activities:

Treatment

Your PHI may be used to provide you with healthcare services and shared with providers involved in your care both within and outside of Mindtra.

Payment

Your PHI may be used to bill and receive payment for services rendered. This includes eligibility verification, claim processing, and utilization reviews.

Healthcare Operations

Your PHI may be used for clinical improvement, staff training, quality assurance, licensing, and business operations necessary to provide you with effective care.

Business Associates

Mindtra may share limited PHI with third-party service providers who assist in business functions. All business associates are bound by HIPAA regulations and contractual obligations to protect your information.

Appointment Reminders and Services

Mindtra may contact you to remind you of appointments or provide information about treatment options or health-related services. You may request preferred methods of communication.

Health and Safety Disclosures

Your PHI may be disclosed if a Provider reasonably believes you pose a danger to yourself or others, or if required to report abuse, neglect, or domestic violence.

Legal Disclosures

PHI may be disclosed in judicial or administrative proceedings in response to court orders, subpoenas, or other lawful processes.

Research

When applicable, Mindtra may share PHI for research purposes under strict conditions and with appropriate safeguards. Identifiable information will not be published.

Workers Compensation

Mindtra may disclose limited PHI in compliance with workers compensation laws.

Change of Ownership

If Mindtra is acquired or merged, your PHI may be transferred as part of the business transaction. You will retain your rights to your PHI.

Breach Notification

If a data breach occurs that compromises your PHI, you will be notified in accordance with federal law.

Incarceration

If you are incarcerated, your PHI may be disclosed to the correctional facility when necessary for your care or safety.

Public Health and Oversight

Mindtra may disclose PHI to public health authorities, oversight agencies, coroners, or medical examiners as required by law.

Military and National Security

PHI may be disclosed to military authorities or for national security and intelligence activities when required by law.

Disclosures Requiring Authorization

Mindtra will not use or disclose your PHI for the following without your written authorization:

  • Psychotherapy notes (unless permitted by law);
  • Substance use disorder treatment records (unless required by law);
  • Marketing communications unrelated to your treatment or care;
  • Sale of your PHI to third parties.

You may revoke any authorization at any time in writing.

Disclosures You May Opt Out Of

You may request not to have your PHI shared with friends, family, or others involved in your care, except where necessary or required by law. You may also opt out of HIE (Health Information Exchange) participation by writing to info@mindtrahealth.com.

Your Rights Regarding PHI

You have the following rights with respect to your PHI:

Right to Access and Copy

You may request a copy of your medical records in paper or electronic form. Requests must be submitted in writing.

Right to Amend

You may request corrections to your records. Mindtra is not required to accept all requests but will provide a written explanation if denied.

Right to an Accounting of Disclosures

You may request a list of certain disclosures of your PHI made over the previous six years, excluding disclosures for treatment, payment, and operations.

Right to Request Restrictions

You may request limitations on how your PHI is used or disclosed. Mindtra may not be required to agree unless the restriction involves self-paid services and the disclosure would otherwise go to an insurance plan.

Right to Confidential Communications

You may request to receive communications via specific means (e.g., only by email or only at work).

Right to a Paper Copy

You may request a paper copy of this Notice at any time, even if you have agreed to receive it electronically.

Right to Notification of a Breach

You will be notified if a breach occurs that compromises the privacy or security of your PHI.

Changes to This Notice

Mindtra reserves the right to revise this Notice and will post updates on www.mindtrahealth.com. Revised Notices apply to all existing and future PHI.

Complaints

If you believe your privacy rights have been violated, you may file a complaint with:

  • The U.S. Department of Health and Human Services (www.hhs.gov/ocr)

Mindtra will not retaliate against you for filing a complaint.
